Major papers were given on the general theme "Spirituality, Nature, and the Self," in preparation for participation in the Sixth Conference of (...) the Society for Buddhist-Christian Studies on "Buddhism, Christianity and Global Healing" held at Pacific Lutheran University on 5-12 August 2000. Although the papers were repeated (in English) at the conference at PLU, the respondents were different.The first paper was given by Okumura Ichirö (a Carmelite priest) on "A Spiritual Pilgrimage: From Buddhism to Christianity." Father Okumura related the story of his spiritual journey, beginning with an interest in Zen and the works of Dögen; his first encounters with Christianity (which were negative); his struggle to understand the teachings of the Bible; his vision of a black-covered Bible with blank pages, and a scorched crucifix; the advice of his Zen Master Nakagawa to be baptized; and his encounter with St. John of the Cross and St. Therese, leading to his becoming a Carmelite priest. A response was given by Nishimura Eshin (Zen priest and Vice President, Hanazono University) who, in his usual feisty manner, noted an empathy for Fr. Okumura's spiritual journey while reaffirming the differences of his own Zen Buddhist faith.The second paper was by Hanaoka Eiko (Professor, Osaka Prefecture University) on "Problems of Spirituality: Facing the Twenty-first Century." Hanaoka approached the issue from her own background in Kyoto School philosophy, presenting five paradigms from which to consider spirituality--relative being, relative nothingness, nihil, absolute being, and absolute nothingness--promoting the paradigm of "absolute nothingness" as the most appropriate for the twenty-first century. The response by Onodera Isao (Professor, Seisen University) reaffirmed the significance of Nishida's philosophy while raising specific questions concerning Hanaoka's presentation, including the query as to how and where "Shinto" would fit in her proposed scheme.The third presentation, opening up the activities on the second day,wasa "research report" by Yagi Seiichi (Professor, Töin University of Yokohama) on "Developing a Theory of Practice for Dialogue Between Buddhism and Christianity." Yagi expressed [End Page 113] a desire to think about "religious practice" as the most important element in religion and couched his discussion in terms of jiga (ego) and jiko (self). He concluded that our contemporary civilization is built with an emphasis on the ego and that Buddhist-Christian dialogue should point to a way beyond egocentrism.The fourth paper was by Kobayashi Enshö (Professor, Hanazono University) on "Maya and Mary: Spirituality and Nature ofTwo Sacred Wombs." Kobayashi examined the respective developments concerning Maya, the mother of Siddhartha, and Mary, the mother of Jesus, in Buddhism and Christianity, pointing out various common elements as well as differences in the role and influence of "mother images" in the history of the two religious traditions. In response, Kawanami Akira (Professor, Töyö University) speculated that a reason for significant differences in the role of Maya and Mary could be due to the presence of Mary throughout Jesus' career, while Maya passed away one week after Siddhartha's birth.The fifth and final paper consisted of another "research report," this time by Takada Shinryö(Professor, Ryukoku University) on "Mappö and Eschatology: What Can Buddhism Learn from Christianity?"Takada, inspired by a symposium on the theme "What Can Christianity Learn from Buddhism"(sponsored by the Nanzan Institute for Religion and Culture in 1997), attempted to compare the meaning of eschatology in Christianity and that of mappö (the degenerate "latter" age) in Buddhism. Speaking from the perspective of Pure Land Buddhism, he emphasized the importance of the idea that "mappö is now" rather than a specific historical period.On the third day, a final summary and discussion was led by Ueda Shizuteru. Suicide attack is the most virulent and horrifying form of terrorism in the world today. The mere rumor of an impending suicide attack can throw thousands of people into panic. This occurred during a Shi‘a procession in Iraq in late August 2005, causing hundreds of deaths. Although suicide attacks account for a minority of all terrorist acts, they are responsible for a majority of all terrorism-related casualties, and the rate of attacks is rising rapidly across the globe. During 2000–2004, there (...) were 472 suicide attacks in 22 countries, killing more than 7,000 and wounding tens of thousands. Most have been carried out by Islamist groups claiming religious motivation, also known as jihadis. Rand Corp. vice president and terrorism analyst Bruce Hoffman has found that 80 percent of suicide attacks since 1968 occurred after the September 11 attacks, with jihadis representing 31 of the 35 responsible groups. More suicide attacks occurred in 2004 than in any previous year, and 2005 has proven even more deadly, with attacks in Iraq alone averaging more than one per day, according to data gathered by the U.S. military. The July 2005 London and Sinai bombings, a second round of bombings at tourist destinations in Bali in October, coordinated hotel bombings in Jordan in November, the arrival of suicide bombings in Bangladesh in December, a record year of attacks in Afghanistan, and daily bombings in Iraq have spurred renewed interest in suicide terrorism, with recent analyses stressing the strategic logic, organizational structure, and rational calculation involved. Whereas they once primarily consisted of organized campaigns by militarily weak forces aiming to end the perceived occupation of their homeland, as argued by University of Chicago political scientist Robert Pape in Dying to Win: The Strategic Logic of Suicide Terrorism, suicide attacks today serve as banner actions for a thoroughly modern, global diaspora inspired by religion and claiming the role of vanguard for a massive, media-driven transnational political awakening. Living mostly in the diaspora and undeterred by the threat of retaliation against original home populations, jihadis, who are frequently middle-class, secularly well educated, but often “born-again” radical Islamists, including converts from Christianity, embrace apocalyptic visions for humanity's violent salvation. In Muslim countries and across western Europe, bright and idealistic Muslim youth, even more than the marginalized and dispossessed, internalize the jihadi story, illustrated on satellite television and the Internet with the ubiquitous images of social injustice and political repression with which much of the Muslim world's bulging immigrant and youth populations intimately identifies. From the suburbs of Paris to the jungles of Indonesia, I have interviewed culturally uprooted and politically restless youth who echo a stunningly simplified and decontextualized message of martyrdom for the sake of global jihad as life's noblest cause. They are increasingly as willing and even eager to die as they are to kill. The policy implications of this change in the motivation, organization, and calculation of suicide terrorism may be as novel as hitherto neglected. Many analysts continue to claim that jihadism caters to the destitute and depraved, the craven and criminal, or those who “hate freedom.” Politicians and pundits have asserted that jihadism is nihilistic and immoral, with no real program or humanity. Yet, jihadism is none of these things. Do we really understand the causes of today's suicide terrorism? Do suicide attacks stem mainly from a political cause, such as military occupation? Do they need a strong organization, such as Al Qaeda? What else could be done to turn the rising tide of martyrdom? (shrink)

Callahan John Francis Callahan, Professor Emeritus of Philosophy and Classics at Georgetown University, died 14 July 2003 after open-heart surgery performed 6 June and was buried with full military honors 17 September at Arlington National Cemetery. His funeral Mass at the Old Post Chapel was concelebrated by his old friend and former (...) colleague, Father Edward W. Bodnar, S.J., who had also concelebrated a memorial Mass in the Jesuit Chapel at Georgetown 5 August.John served on the Board of Editors and the Board of Directors of the Journal of the History of Ideas from 1970 until his death and was Vice-President from 1985. President Trump’s decision to move his official state of residence from high-tax New York to no (income)-tax Florida has brought public attention to an issue that has long troubled scholars, designers and administrators of income tax systems: how the interaction of tax rules deferring the taxation of income and tax rules based on residency allows taxpayers to reduce and even avoid taxation of their deferred income. These discontinuities in tax treatment may lead to excessive migration, as well as reductions (...) in state income tax revenues and distortions in the design of state taxing mechanisms. This Article explains what states would have to do to eliminate these avoidance opportunities. However, it also points out that many of these policy changes would create other tax discontinuities. Ultimately, it leaves open the question whether making any of these changes would lead to fewer financial and behavioral distortions. (shrink)

Heather Battaly has argued that vice-epistemology has a Responsibility Problem. From analysing the ‘card-carrying feminist’ committing testimonial injustice due to implicit gender bias, Battaly argues that non-voluntarist vice-epistemologists are committed to either (1) counting some vices as blameworthy yet not reprehensible, or (2) holding agents equally responsible for cognitive defects as for implicit bias. This in turn implies that (2a) epistemic vices include certain cognitive defects or (2b) that implicit bias is excluded as epistemic vice. This paper (...) aims to deflate the Responsibility Problem, by arguing that vice-epistemologists can embrace route (2b) without problematic implications. In applying Miranda Fricker’s ‘no-fault responsibility’ to the card-carrying feminist case, I defend the following three claims: First, Battaly’s analysis of the card-carrying feminist case is flawed, because it fails to acknowledge that the vice of testimonial injustice and implicit prejudice are conceptually distinct. Second, excluding implicit prejudice as a vice is actually compatible with Fricker’s theoretical commitments. Third, contrary to what much of the literature seems to assume, it isn’t that problematic to exclude (individual) implicit bias as a vice, or to assign equal responsibility for implicit prejudice as for cognitive defects like impaired vision. We argue that while presidential candidates have the right to medical privacy, the public nature and importance of the presidency generates a moral requirement that candidates waive those rights in certain circumstances. Specifically, candidates are required to disclose information about medical conditions that are likely to seriously undermine their ability to fulfill what we call the "core functions" of the office of the presidency. This requirement exists because (1) people have the right to be governed only with their consent, (2) (...) people's consent is meaningful only when they have access to information necessary for making informed voting decisions, (3) such information is necessary for making informed voting decisions, and (4) there are no countervailing reasons sufficiently strong to override this right. We also investigate alternative mechanisms for legally encouraging or requiring disclosure. Protecting the public's right to this information is of particular importance because of the documented history of deception and secrecy regarding the health of presidents and presidential candidates. If one thing that the failed coup by a small but some of the top hierarchy of Turkish armed forces on that fateful July 15, 2016 day made clear, it was: the ordinary civilians, unarmed as they were poured into the streets to defend the government whatever way they can. This massive public sympathy and support for Turkish resident Erdogan and his government would be hard, if not impossible to understand, without knowing the historical intellectual, academic, and moral combat between (...) the modernists and Islamist groups working within the country. Mustafa Kamal had turned Turkey, mostly by force, from Ottoman Empire into the secular mode using military power. Various Islamic revolutionary outfits struggled for the revival of Ottoman Empire. Among them Bedi-uz-Zaman Said Nursi managed to cast a strong influence. A little slow but steadfast effort influenced by Nursi movement. Islam-shy Western powers managed alternate power structure against sitting President Tayyep Erdogan. They, however, failed due to result oriented social work delivered by his regime as Mayor and Prime Minister. It is a lesson for other revolutionaries and Governments especially for Islamic revolutionaries that if politicians deliver no power can oust them like a bee from butter. (shrink)

Ever since August 2001, when President Bush announced his shaky compromise policy on federal funding for research on stem cells, American scientists have been charging that the policy severely impedes progress in this promising new area. Bush's policy allowed federal funding only for research using stem cell lines that were in existence on the date of his speech. Thus, he maintained, such funding would not encourage anyone to destroy human embryos to obtain stem cells, because if they did so, (...) the newly created stem cell lines could not be developed or studied with federal funding. Thus liberals characteristically claim that the traditional standing of a social arrangement contributes little or nothing to its political legitimacy. Whether an arrangement is legitimate depends upon whether or not those (...) who currently live under it can understand and accept its rationale. Members of each generation must be able to examine arrangements as if they themselves were signatories of the social contract; the justification of regimes must, as it were, be susceptible of renewal in every age and to every citizen. Jefferson gave this view its most extreme expression when he claimed that each generation has the right to begin its nation's political life anew, and that national constitutions should be rewritten every two decades.2 Liberals often seem no kinder to intellectual than to political traditions. As they think political life can periodically begin anew, so they sometimes seem to think that political and moral philosophy can begin anew. To take but one example of this neglect of the past, the ethical writings of scholasticism are dominated by richly detailed analyses of the virtues and vices, yet liberal writers roundly ignore these discussions. Liberals have been quick to defend their suspicions of the thought and politics of the past, but critics of liberalism have been equally quick to seize upon them. Champions of virtue ethics have been among the most vocal critics of liberalism in recent years, arguing that liberals court philosophical peril by neglecting the insights of earlier moral theories. Edmund Burke, the eighteenth-century opponent of liberalism, had an additional complaint. Burke discerned an arrogance in the liberal rejection of intellectual and political tradition. It was mere pride, Burke thought, to suppose that politics and political theory could be made transparent to the reason of every individual in the way that liberals sometimes claim.4 Burke's allegation that the liberal rejection of tradition reflects pride is ironic, for pride is a central element of one of the traditions of moral thought that liberals seem determined to reject. During a lengthy period of philosophy's history, pride was thought to be a motive of all wrong action. The biblical book of Sirach says that pride is the beginning of all evil5 and a long line of medieval moralists labored to explain how this might be so. Yet the tradition of moral thought that accorded pride so central a role now suffers from neglect at the hands of many philosophers. And pride itself is a vice that many philosophers now consider unworthy of attention. Most fail to consider it seriously as a motive for any wrong action at all. I have three aims in this paper. One is to examine pride's neglect more closely. I shall argue that pride suffers this neglect because of its centrality to a religiously based tradition of moral thought that many philosophers no longer accept. This article examines Bolivian vice president Álvaro García Linera’s use of concepts originating in the work of Antonio Gramsci and Bolivian sociologist René Zavaleta Mercado. Zavaleta’s concept of sociedad abigarrada has a history of misappropriation in which García Linera participates by articulating it with the related concept of the estado aparente to claim that the merely ‘apparent’ state which does not effectively represent the heterogeneous social reality of a country like Bolivia is abolished with the official establishment of (...) the Plurinational State in 2009. This ideologeme of the Plurinational State as one that faithfully represents Bolivia’s abigarramiento is equated with the Gramscian stato integrale, which in Gramsci refers to the state proper plus civil society where these are thoroughly integrated to function as an organic whole. Beyond merely misusing the borrowed terms of this discursive operation, García Linera gives a prescriptive value to concepts developed for an analytical purpose to validate the existing regime. Malapportionment—electoral districts with divergent ratios of people to representation—was ruled to be unconstitutional in a widely venerated series of cases before the Warren Court. Those cases held that a principle of political equality, ‘one person, one vote’, is required by the Constitution. But what is the content of that principle? Many Justices and commentators declare that it is vague, empty, circular, or meaningless. This creates a murder mystery. Malapportionment was killed; but by what, exactly? This Article seeks an answer by (...) focusing on the Court’s commitments about the scope and strictness of one person, one vote: it is a broad (rather than narrow) principle of rough (rather than exact) equality. As such, one person, one vote requires an equal number of people per district and an equal number of votes per voter; and it requires a roughly equal number of people per district. These commitments are attractive in isolation. But, this Article shows, they are objectionable in conjunction: they entail that one person, one vote is too permissive, as it only requires a roughly equal number of votes per voter. If your vote is roughly equal to mine when your district is fractionally more populous than mine, your vote is also roughly equal to mine when I can cast fractionally more votes than you. -/- Since this problem follows inexorably from the Court’s commitments about the scope and strictness of one person, one vote, there are two possible solutions. First, one person, one vote could be broad a principle of exact equality; administrability may then justify underenforcing the principle in distributing voters to districts, but not in distributing votes to voters. Second, one person, one vote could include a narrow principle requiring rough equality in apportionment, as well as a distinct principle requiring exactly equal votes per voter. These solutions have important constitutional implications—including for resolving the population baseline at issue in malapportionment, which remains uncertain after Evenwel v. Abbott. But neither provides an easy way out. Each makes one person, one vote either too restrictive or too permissive. -/- This puzzle brings to light why the operative principle in a venerated series of cases is deeply unclear and unsettled. But it has a special significance beyond that. One person, one vote lies at the heart of America’s constitutional democracy, which is already under considerable threat. On the one hand, if the content of the principle is too restrictive (or too uncertain), then objections to its constitutionality are considerably strengthened. On the other hand, if it is too permissive, then one person, one vote provides little constraint on Vice-President J.D. Vance’s recent proposal to give extra votes to parents, as well as myriad similar policies and procedures that would erode voters’ equality at the ballot box. (shrink)

In 1992, the United States Supreme Court, in Planned Parenthood of Southeastern Pennsylvania v. Casey, upheld the ruling in Roe v. Wade, namely that women have a right “to choose to have an abortion before viability and to obtain it without undue interference from the State.”1 However, since this ruling, some states have imposed regulations that greatly limit this right by restricting access. Texas is a recent example of this. Two proposed restrictions in House Bill 2, which will be discussed (...) in detail below, will force all but eight clinics that are located in metropolitan areas to shut down. The U.S. Supreme Court put the proposed restrictions on hold in October 2014, allowing several clinics to remain open while the restrictions are being appealed in the U.S. Court of Appeals for the Fifth Circuit. If the restrictions are passed, however, those clinics will be forced to shut down and, as a result, many women in Texas will be required to travel more than 100 miles in order to access a safe and legal abortion. Much of the focus of these restrictions has been on women and rightly so. However, I want to turn the attention to physicians. The requirements exacerbate unfair treatment of abortion providers compared with other physicians. Abortion providers face threats from the public—some of which turn into violent attacks—and they are often ostracized by their fellow medical practitioners. There are so few abortion providers to begin with and the proposed requirements limit these physicians’ opportunities to practice the branch of medicine of their choosing. Although the HB 2 requirements may not result in an unconstitutional undue burden on physicians, the challenges created by the bill limit physicians’ abilities to provide abortions. As a result of these limits, HB 2 creates an unconstitutional undue burden for women seeking abortions by creating barriers directed at abortion providers and clinic staff who are willing and able to provide abortions. The first of the two controversial HB 2 requirements is the admitting privileges requirement: “A physician performing or inducing an abortion must, on the date the abortion is performed or induced, have active admitting privileges at a hospital that is located not further than 30 miles from the location at which the abortion is performed or induced.”2 The second requirement is the ambulatory surgical center requirement: “The minimum standards for an abortion facility must be equivalent to the minimum standards adopted under [Texas Health & Safety Code] [...] for ambulatory surgical centres.”3 In order to meet these state-mandated obligations, some abortion clinics would have to spend more than $1 million in upgrades if they wish to remain open. The District Court decided that the ambulatory surgical center requirement places an unconstitutional undue burden on women, and that the two requirements together place an undue burden on women in Texas and especially in the Rio Grande Valley where the nearest clinic is a couple hundred miles away.4 Later, the U.S. Court of Appeals for the Fifth Circuit reversed the District Court’s decision and argued, “the admitting privileges requirement is constitutional on its face.”5 While the regulations are being appealed, the Supreme Court granted a stay of injunction, allowing about twelve abortion clinics to reopen until a final decision regarding the regulations is made. The District Court ruled that the purpose of the two regulations was to create a substantial obstacle for women seeking abortions in Texas. While the defendants argued that the regulations were designed to make abortions safer and reduce risk, the Court decided that this was not the case. An abortion, especially a first-term abortion, is a very safe procedure and is safer than many other routine surgical procedures. As stated in Planned Parenthood v. Casey, “Unnecessary health regulations that have the purpose or effect of presenting a substantial obstacle to a woman seeking an abortion impose an undue burden on the right.”6 The undue burden in this case is imposed, not through restricting women’s access directly, but by restricting physicians’ freedom to perform abortions. The admitting privileges requirement has reduced the number of physicians who can perform abortions and the ambulatory surgical center requirement has reduced the number of clinics where abortions can be performed. The American Medical Association states, “[t]he Principles of Medical Ethics of the AMA do not prohibit a physician from performing an abortion in accordance with good medical practice and under circumstances that do not violate the law.”7 This means that physicians are not required to perform abortions, except in emergency situations, but can as long as the procedure is done safely and does not violate the law. The new Texas regulations, however, are so restrictive that few abortion providers, limited to only four urban areas, can legally perform abortions. Physicians do not have an absolute right to perform abortions as opposed to women who have an absolute right to have access to an abortion. Physicians do face many challenges that other professionals face in terms of obtaining qualifications and finding work. Abortion providers, however, face challenges that most other physicians do not. The restrictions imposed by these regulations exacerbate unfair treatment toward abortion providers and place further obstacles in their path in terms of providing the service they want and are qualified to provide. Both abortion clinics and abortion providers are being treated differently from other medical clinics and physicians. For instance, “grandfathering of existing facilities and the granting of waivers from specific requirements is prohibited for abortion providers, although other types of ambulatory surgical facilities are frequently granted waivers or are grandfathered.”8 Many abortion clinics cannot afford the necessary upgrades. Furthermore, it is extremely expensive to open a brand new clinic that complies with the ambulatory surgical center requirements. Being grandfathered in would be the only option available to abortion clinics that cannot afford the upgrade. However, unfair treatment of abortion clinics and providers is preventing those clinics from being grandfathered into the new system. As a result, many abortion clinics may be forced to close. Admitting privileges are proving difficult or impossible for physicians both to obtain and, for those who have already been granted privileges, to keep. Dr. Sherwood Lynn, an obstetrician-gynecologist who has performed abortions for decades, describes the process of obtaining admitting privileges and the difficulties abortion providers face. After sending in an application a physician must wait for the hospital to send them the required materials, “but if the address of the practice on the application is of an abortion provider or clinic, [the hospital] won’t send [them] the package of materials required. [They] simply can’t apply.”9 Dr. Lynn and several other physicians have surmised that hospitals are only withholding privileges from qualified physicians who perform abortions and that other physicians do not face this discriminatory treatment. Hospitals have also revoked privileges granted to physicians after learning that the physicians perform abortions. For instance, in Texas two doctors, “received notices [...] informing them that their admitting privileges to the University General Hospital of Dallas have been revoked, with the hospital’s CEO claiming the hospital was unaware they were providing abortion care and that the hospital believed such care would damage its reputation.”10 What is curious about this revocation is that, “federal and state laws [...] forbid hospitals from discriminating against doctors who perform abortions,” and yet hospitals are clearly doing just that.11 Dr. Pamela Richter, another abortion provider in Texas, had her temporary admitting privileges revoked with no explanation and because of this, the clinic where she performed abortions, Reproductive Services, can no longer provide abortions at all.12 As the hospital gave no reason for the revocation, it not clear Dr. Richter’s privileges were revoked because she performs abortions. Dr. Richter, however, has performed over 17,000 abortions and her privileges were revoked soon after HB 2 was introduced.13 According to the Texas Hospital Association, giving admitting privileges to doctors who do not work for the hospital is expensive and time-consuming but this does not account for the fact that hospitals are revoking previously granted privileges from physicians whom they learn are providing abortion services.14 As mentioned previously, the District Court found that the admitting privileges requirement and the ambulatory surgical center requirement do not further ensure the health and safety of women undergoing an abortion. Several physicians have testified to this fact. Dr. Lynn stated in an interview: The admitting privileges requirements are [...] absolutely unnecessary. If you have a number of patients waiting for procedures, and something happens and a patient needs to be transferred to a hospital, you’re not going to leave everyone else and go to the hospital. That makes no sense. You’re going to refer that person to a gynecologist at the hospital. There is no safety issue involved here. If a patient shows up with an emergency, every hospital is required to admit that patient. They have to by law.15 It is rare that complications will arise from an abortion performed in a clinic. Dr. Richter, for example, has performed more than 17,000 abortions and not once had to send a patient to a hospital because of complications resulting from the procedure. According to Dr. Lynn even if abortion providers were granted privileges to hospitals, it is unlikely that they will exercise them. In essence, having admitting privileges at a hospital does nothing to further ensure the safety of an already safe procedure. The only result of the admitting privileges requirement is to limit certain physicians’ ability to perform legal abortions. Not only do the HB 2 requirements fail to further ensure the health and safety of women, the HB 2 requirements may actually create more health risks to women who cannot access the eight remaining clinics. The first risk is that the remaining clinics would have an influx of patients that they may not be able to handle, forcing women to wait longer for an appointment. As stated by the District Court, “[e]ven assuming every woman in Texas who wants an abortion [...] could travel to one of the four metropolitan areas where abortions will still be available, the cumulative results of HB 2 are that, at most, eight providers would have to handle the abortion demand of the entire state.”16 Furthermore, “[t]hat the State suggests that these seven or eight providers could meet the demand of the entire state stretches credulity.”17 Abortion is a time sensitive procedure. It is safest when performed early in a pregnancy. The increase in patients to these remaining clinics, assuming all women in Texas can access them, will increase wait times and may force women to have abortions later in pregnancy. In the worst-case scenario, a woman would not see an abortion provider at all before viability. Such instances may be rare, but they are possible. In such cases, women’s access to legal abortions becomes impossible and thereby violate the ruling in Roe. Clinics may be able to avoid the aforementioned problems if they hire more physicians. However, there are two barriers to hiring more physicians. First, as mentioned previously, admitting privileges to Texas hospitals are difficult, if not impossible, for abortion providers to obtain. Second, given the negative treatment of abortion providers by anti-abortion groups, many physicians are not willing to perform abortions. The harassment abortion providers face is unique to those physicians and many physicians will not perform abortions for that reason. In an article published in the Austin Chronicle, anti- abortion activist Abby Johnson, “discusses how her group investigated appraisal district records to find the new location of where an Austin abortion physician plans to work.”18 Johnson states, “These abortionists are feeling the pressure from the pro-life movement in Texas. I think they feel like they’re on the run. And that’s how we want to keep it.”19 If the HB 2 requirements are passed and there remain at most eight abortion providers in Texas, these activists will concentrate on those clinics and, “the dangerous impact of their intimidation tactics will be exacerbated.”20 Even if the number of physicians needed to meet the demand in Texas can obtain admitting privileges and work at one of the remaining clinics, they may choose not to do such work because they are putting themselves at risk. The harm abortion providers face from such anti-abortion groups is not unique to Texas. There are stories from all over the country and from other countries where abortion is legal of physicians receiving death threats. Dr. George Tiller, an abortion provider in Kansas, was killed outside his church and had received numerous death threats prior to this. The HB 2 requirements are making it so that abortion providers either cannot provide their services any longer or will face increased threats and increased danger to themselves. Physicians are allowed to conscientiously object to providing medical interventions in certain circumstances for moral and religious reasons. However, there are limits on this right. According to the American Congress of Obstetricians and Gynecologists, “[w]hen conscientious refusals conflict with moral obligations that are central to the ethical practice of medicine, ethical care requires that the physician provide care despite reservations or that there be resources in place to allow the patient to gain access to care in the presence of conscientious refusal.”21 I would argue fear for one’s safety in the face of immediate threats is perhaps a stronger ground on which to refuse to provide care than a personal belief that abortion is immoral or against one’s religion. ACOG also states, “[p]roviders with moral or religious objections should either practice in proximity to individuals who do not share their views or ensure that referral processes are in place so that patients have access to the service that the physician does not wish to provide.”22 This responsibility has been largely disputed by the medical community but in cases of rape, incest, and health risks to women, referrals must be made without exception. However, under the requirements of HB 2, working in proximity to an abortion provider may not be possible because they are so geographically limited. Referrals are supposed to be made within reason. Some areas of Texas, such as the Rio Grande Valley, are up to 200 miles away from the nearest clinic that would remain open if HB 2 is passed. Referrals may simply not be feasible given the geographical distances and the decreasing number of available physicians. As mentioned above, there are two risks to the health and safety of women as a result of HB 2. The second of these is that if a woman cannot access one of the remaining clinics, she may seek out a more convenient but illegal and unsafe abortion, which is far more likely to result in a dangerous complication. Dr. Lynn states, “[b]ecause of the restrictions lawmakers impose, women will seek abortions illegally, and we’re going to see a rise in septic abortions.”23 Some areas of Texas might effectively revert back to a pre-Roe era where abortions were performed in unsanitary conditions by unqualified people resulting in dangerous medical complications far more often than legal abortion procedures do now. Physicians like Dr. Lynn who want to prevent this from happening generally cannot do so without facing legal sanction. Physicians have a duty to provide safe medical care and if they cannot obtain admitting privileges, they cannot exercise this duty. ACOG released a statement expressing their objections to the new requirements. They state that HB 2 is, “plainly intended to restrict the reproductive rights of women in Texas through a series of requirements that improperly regulate medical practice and interfere with the patient-physician relationship.”24 Executive Vice-President of ACOG, Hal C. Lawrence III stated: The Texas bills set a dangerous precedent of a legislature telling doctors how to practice medicine and how to care for individual patients. ACOG opposes legislative interference, and strongly believes that decisions about medical care must be based on scientific evidence and made by licensed medical professionals, not the state or federal government.25 Abortion is one of only a few areas of medicine where the legislature imposes so many regulations restricting particular physicians’ ability to practice medicine. Not only are abortions providers being regulated by the state, they are also facing clear discrimination from others within the medical community. The state is closing down clinics that do not meet the ambulatory surgical center requirements and hospitals are denying physicians admitting privileges because they perform abortions. In summary, abortion providers are being discriminated against both by the legislature and other members of the medical community. Other physicians who do not perform abortions are not denied admitting privileges on discriminatory grounds. Clinics that cannot afford upgrades to become an ambulatory surgical center are being grandfathered in, while abortion clinics are being forced to close down. Ob-Gyns who conscientiously object to performing abortions and who are not located in close proximity to at least one abortion provider cannot effectively fulfill their duty to refer patients. Lastly, given the barriers these regulations will create, there will likely be a rise in complications resulting from abortions provided under grossly unsafe conditions. Physicians, whose duty it is to provide safe and effective medical care, are being denied the right to exercise this duty. While this denial may not be unconstitutional, it is certainly unjust and discriminatory and creates obstacles that other physicians do not face. Most importantly, these obstacles are creating an undue burden for women. The HB 2 requirements do not increase the health and safety of abortions; all they do is create substantial obstacles for women. In light of these observations, the requirements seem to me to be in clear violation of Casey, in which it was decided that, “[u]nnecessary health regulations that have the purpose or effect of presenting a substantial obstacle to a woman seeking an abortion impose an undue burden on that right.”26 These regulations do just what Casey was meant to prohibit and this is accomplished through limiting physicians’ ability to practice safe abortions across the state of Texas. Do chief financial officers (CFOs) of publicly held corporations agree with the Institute of Management Accountants' (IMA) Standards of Ethical Conduct and are they willing to adopt them? To address these issues, a survey was conducted concerning the Standards. The IMA issued the Pronouncement of Standards in June, 1982.In November, 1992, 790 survey questionnaires were mailed to chief financial officers (CFOs) of corporations listed in Forbes. These CFOs held the positions of vice president of finance and controller. Completed (...) questionnaires were received from 208 CFOs representing a 26.3% response rate. Craig Nelson, the author of this unflaggingly engrossing book, comes from an impressive background in publishing, having been vice president and executive editor of Harper and Row, Hyperion, and Random House. In this respect, he reminds me of the better known Walter Isaacson, who was managing editor of Time magazine before turning his attention to writing biographies of Einstein, Steve Jobs, and Ben Franklin, and, most recently, a collective biography of the pioneers of the digital revolution. Although I (...) reach this conclusion on the basis of having read only one book by each, I would say that Isaacson’s oeuvre is more scholarly, Nelson’s more journalistic. A review in the New York Times of Nelson’s bestseller Rocket Men informs would-be readers that while the book “lacks the shapeliness and authority of some earlier lunar histories,…it ends up making an engaging contribution.” Comparing The Age of Radiance to the many similar histories of radioactivity and the making of the bomb that I .. He was one of the most distinguished historians of philosophy of his generation. Early in his studies he had found Locke's Essay Concerning Human Understanding a challenging book that raised as many puzzles as it answered and it was his engagement with that work that dominated his intellectual enquires from his MA studies (...) until his latest book, published last year, The Two Intellectual Worlds of John Locke. Man, Person, and Spirits in the "Essay." It was his fifteenth authored book. His first book was his Oxford D. Phil. Thesis, John Locke and the Way of Ideas, published nearly fifty years ago in 1956. If Locke and Ideas were to dominate his writings, they were not exclusive of other interests. His second book was The Philosophy of A.S. Eddington. Others, not Locke-centered, were to follow. In later years he has focussed especially on the problem for all readers of Locke and other early modern philosophers including Descartes, Berkeley and Hume, as to the nature of their commitment to ideas. Did they really hold that ideas are objects that intervene between the perceiving mind and the outside world, or is the standard reification of ideas simply a mistaken reading of their argument? Yolton, since at least the early 1980s, has argued that to reify ideas in the standard way is based on a false reading of the texts. His reading has not always been accepted by historians of philosophy but there are signs that that might be changing and some books and articles published in the last five years or so reveal distinct signs of a Yolton influence.John Yolton was not only a prolific writer he was also a highly regarded editor, not only of Locke texts but also of important collections of papers such as John Locke: Problems and Perspectives (1969) and The Blackwell Companion to the Enlightenment (1992) to which he contributed [End Page 419] a prodigious number of entries. But perhaps as important as his writing was Yolton's teaching. Nobody who sat in on one of his classes could not but be impressed with the way in which he was able to hold a class's attention to a text of Descartes, Locke or Hume and engage first year or graduate students in a scrutiny of the text, perhaps only a paragraph or even a sentence long, teasing out its ambiguities and its place in an argument, to the obvious enlightenment of students who until then had found early modern philosophical prose dull and uncaptivating. It is no surprise to find that he supervised a large number of scholars of the early modern period who have gone on to make important contributions to the history of philosophy and intellectual history.John Yolton was always enormously generous with his time. His graduate students became extensions of the Yolton family. So also did younger scholars. Any book or paper sent him was always to receive careful attention and detailed comment, always fair but never patronising. He was also very active as a member of many editorial boards, including the Journal of the History of Ideas and the Clarendon Locke Board. John was appointed to the Board of Consulting Editors of the JHI in 1977. At the beginning of 1987 he was elected to the Board of Editors and he was still a member of that Board at the time of his death. During his membership on both boards he provided an enormous amount of editorial help, evaluating scores of submitted papers. He was especially active during the years that the Journal's editorial office was located at Rutgers University. How do senior business executives rank their preferences for various ethical principles? And how strongly do the executives believe in these principles? Also, how do these preference rankings relate to the way the executives see the future (wherein business decisions play out)? Research on these questions may provide us with an appreciation of the complexities of ethical behavior in management beyond the traditional issues concerning ethical decision-making in business. Based on a survey of 585 vice presidents of U.S. businesses (...) it was found that: (1) there is a distinct set of principles of ethical conduct that is considered favorable as opposed to another set considered unfavorable among a comprehensive list of 14 ethical principles; (2) the executives believed overwhelmingly that their own individual ethical preferences are better than those of other executives; (3) the strength of their preferences for ethical principles is associated with whether the executives are relatively near-future oriented or more distant-future oriented; and (4), there are very few significant differences in terms of gender, age, education level, private/public education, prestigious/other schools, business/non-business academic backgrounds, and length of job experience. The annual meeting of the Society for Buddhist-Christian Studies in Nashville decided that the next international conference will be held August 5-12, 2003, in Chiang Mai, Thailand.An invitation was extended to the society by Dr. John Butt, director of the Institute for the Study of Religion and (...) Culture (ISRC), and by the president of Payap University, Dr. Boonthong Poocharoen. As a Presbyterian faculty member of the McGilvary Faculty of Theology, John has extensive interreligious experience in Thailand and participated in the society's last international conference held in Tacoma, Washington, in August 2000.The institute's associate director, Professor Saeng Chandrangam, is a former Buddhist monk and is one of Thailand's most highly respected Buddhist laymen. He was Chair of the Department of Oriental Studies and the Department of Modern Languages and was Dean of Humanities of the government's Chiang Mai University, where he taught philosophy and theology. Currently he teaches at a Buddhist university in Chiang Mai as well as serving as the associate director ofISRC. Gleeson, Damian John In 1924, after a hiatus of a decade, the Australasian Catholic Record was re-established under the driving force of Monsignor John Joseph Nevin, the then vice-president of St Patrick's College, Manly. Mgr Nevin was ACR's principal editor up until 1937 and with the exception of a trip to Ireland and Europe in 1927, he contributed articles and answered questions on topics ranging across canon law, marriage, and moral theology in virtually every quarterly issue of ACR (...) for more than two decades. At Manly, he educated thousands of seminarians for dioceses across New South Wales and beyond, and was the college's president from 1929 to 1942. As such, Mgr Nevin was probably the most formidable Catholic clerical academic in New South Wales in the interwar period, yet we know little of this prodigious writer and intellectual who was a key adviser, not just to the Sydney hierarchy, but to a wide range of bishops. Apart from Dr Kevin Walsh's splendid history of St Patrick's College, Manly, church historians have not sought to consider the significant career of Mgr Nevin and his influence on several generations of clergy and bishops. In Ogborn v. United Food & Commercial Workers Union, Local No. 881, the U.S. Court of Appeals for the Seventh Circuit held that while major depression can constitute a disability under the Americans with Disabilities Act, isolated bouts of depression do not. Furthermore, the court held that an employee's firing after taking medical leave for depression does not violate the Family and Medical Leave Act, where evidence shows that the employee would have been fired for poor performance even if he (...) had not taken the leave.Alleging that he was fired in violation of the ADA and the FMLA, Jerry Ogborn sued his former employer, Local 881 of the United Food and Commercial Workers Union, as well as the union's vice president. Beginning in 1980, Ogborn worked as a business agent for the union, which represents members employed primarily in the retail grocery industry. Ogborn's duties consisted of visiting retail grocery stores employing workers represented by the union, meeting with members about working conditions, and filing and processing members’ grievances. In a corporate context, would interrupting affect the perceived power, identity traits, job performance, and interpersonal relationships of equally situated male and female speakers? The gender of both the interrupter and the interrupted speaker was varied in hypothetical transcripts of conversations between two corporate vice-presidents. There were no significant effects of interrupting or being interrupted on perceptions of the relative power of men and women speakers. However, the interrupter, regardless of gender, was perceived as more successful and driving, but (...) less socially acceptable, reliable, and companionable than the interrupted speaker. (shrink)
